Introduction

Flashallowed respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website, Flashallowed will respond expeditiously to claims of copyright infringement committed using the Flashallowed service and/or website.

DMCA Notice of Alleged Infringement (“Notice”)

If you are a copyright owner, or authorized to act on behalf of one, please report alleged copyright infringements on or through the site by completing the following DMCA Notice of Alleged Infringement and delivering it to Flashallowed’s Designated Copyright Agent.

Upon receipt of the Notice as described below, Flashallowed will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the site.

Requirements for a Valid Notice

Your DMCA Notice must include the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
  2. A description of the copyrighted work or other intellectual property that you claim has been infringed.
  3. A description of where the material that you claim is infringing is located on the site, sufficient for Flashallowed to locate the material (providing URLs in the body of the notice is the most efficient way).
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to upload and use the content, you may send a written counter-notification to our Copyright Agent containing the following:

  1. Your physical or electronic signature.
  2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
  3. A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court located in your jurisdiction and that you will accept service of process from the person who provided notification of the alleged infringement.

Repeat Infringers

Flashallowed will, in appropriate circumstances, terminate the accounts of users who are repeat infringers. If you believe that a user is a repeat infringer, please contact us at contact@flashallowed.com and provide information sufficient for us to verify that the user is a repeat infringer.
